FCC Adopts MB 05-331 Harming PEG Access

The same large corporations who were influencing Congress have succeeded in influencing the Federal Communications Commission (FCC) to reduce the obligations that protect the public interest and your voices. This rule-making is the bureaucratic version of the national telecom laws we helped to stall this past year. It appears the FCC has taken up creating policy, usurping the role of Congress.

FCC Adopts Rules to Ensure Reasonable Franchising Process for New Video Market Entrants.
R&O & NPRM: Word | Acrobat

------------------------------------------------

Part of what is being proposed by the FCC:

  • All PEG, I-Net and other in-kind services would be counted against 5% franchise fees.  5% would be an absolute cap. In Montgomery County we receive approximately 8%. This would result in major cuts to the budget that supports public access.
  • Municipalities would have to approve new franchises for telephone companies within 90 days or allow them to operate without franchises.
  • There would be no build-out requirements allowed whatsoever meaning that only the more affluent and more dense sections of our county would wired.
  • We have heard of a possible Further Proposed Rule Making that would eliminate PEG channels on future competitive video franchises.

Click here for the full proposed rule making in draft form as it was presented prior to their meeting of December 20.
